Les présentes conditions générales d'utilisation (dites « CGU ») ont pour objet l'encadrement juridique des modalités de mise à disposition du site et des services par SERACS et de définir les conditions d’accès et d’utilisation des services par « l'Utilisateur ».

L’édition et la direction de la publication du site SERACS est assurée par le dirigeant de l'entreprise propriétaire.

L'hébergeur du site SERACS est la société Hostinger.

Le site est accessible gratuitement en tout lieu à tout Utilisateur ayant un accès à Internet. Tous les frais supportés par l'Utilisateur pour accéder au service (matériel informatique, logiciels, connexion Internet, etc.) sont à sa charge.

ARTICLE 3 : Collecte des données

Le site assure à l'Utilisateur une collecte et un traitement d'informations personnelles dans le respect de la vie privée conformément à la loi n°78-17 du 6 janvier 1978 relative à l'informatique, aux fichiers et aux libertés.

En vertu de la loi Informatique et Libertés, en date du 6 janvier 1978, l'Utilisateur dispose d'un droit d'accès, de rectification, de suppression et d'opposition de ses données personnelles. L'Utilisateur exerce ce droit par mail à l'adresse email : seracs.contact@gmail.com

ARTICLE 4 : Propriété intellectuelle

Les marques, logos, signes ainsi que tous les contenus du site (textes, images, son…) font l'objet d'une protection par le Code de la propriété intellectuelle et plus particulièrement par le droit d'auteur.

L'Utilisateur doit solliciter l'autorisation préalable du site pour toute reproduction, publication, copie des différents contenus. Il s'engage à une utilisation des contenus du site dans un cadre strictement privé, toute utilisation à des fins commerciales et publicitaires est strictement interdite.

Toute représentation totale ou partielle de ce site par quelque procédé que ce soit, sans l’autorisation expresse de l’exploitant du site Internet constituerait une contrefaçon sanctionnée par l’article L 335-2 et suivants du Code de la propriété intellectuelle.

Les sources des informations diffusées sur le site SERACS sont réputées fiables mais le site ne garantit pas qu’il soit exempt de défauts, d’erreurs ou d’omissions.

Les informations communiquées sont présentées à titre indicatif et général sans valeur contractuelle. Malgré des mises à jour régulières, le site SERACS ne peut être tenu responsable de la modification des dispositions administratives et juridiques survenant après la publication. De même, le site ne peut être tenue responsable de l’utilisation et de l’interprétation de l’information contenue dans ce site.

Le site SERACS ne peut être tenu pour responsable d’éventuels virus qui pourraient infecter l’ordinateur ou tout matériel informatique de l’Internaute, suite à une utilisation, à l’accès, ou au téléchargement provenant de ce site.

L’Utilisateur est informé que lors de ses visites sur le site, un cookie peut s’installer automatiquement sur son logiciel de navigation.

Les cookies sont de petits fichiers stockés temporairement sur le disque dur de l’ordinateur de l’Utilisateur par votre navigateur et qui sont nécessaires à l’utilisation du site SERACS. Les cookies ne contiennent pas d’information personnelle et ne peuvent pas être utilisés pour identifier quelqu’un. Un cookie contient un identifiant unique, généré aléatoirement et donc anonyme. Certains cookies expirent à la fin de la visite de l’Utilisateur, d’autres restent.

L’information contenue dans les cookies est utilisée pour améliorer le site SERACS.

ARTICLE 8 : Droit applicable et juridiction compétente

La législation française s'applique au présent contrat. En cas d'absence de résolution amiable d'un litige né entre les parties, les tribunaux français seront seuls compétents pour en connaître.

Pour toute question relative à l’application des présentes CGU, vous pouvez joindre l’éditeur aux coordonnées inscrites à l’ARTICLE 1.

Conditions et règlement concours Instagram :

Conditions du concours :

1. Pour participer, vous devez être âgé de 18 ans ou plus.
2. Afin d’être éligible :

- Assurez-vous de suivre notre compte Instagram "@seracs.freeski" ;

- Assurez-vous d'avoir bien liké le post, et posté un commentaire sous la publication informant du dit concours. Ce commentaire doit contenir au moins 2 identifications de comptes Instagram, dont vous connaissez réellement le propriétaire. Des vérifications peuvent avoir lieu.

- Assurez-vous d’avoir republié le post informant du concours, en story. Une vérification aura lieu si vous êtes le gagnant du concours.

3. Assurez-vous d'être disponibles le 30/03/24.

4. Assurez-vous d’habiter dans le Rhône, en métropole Grenobloise, ou à proximité du trajet reliant Lyon à la station de skis de l’Alpe d’Huez.

5. Les conditions de neige dans la station de l’Alpe d’Huez doivent être favorables afin de garantir la réalisation de l’évènement.

6. L’organisateur (SERACS) se réserve le droit d’annuler l’évènement, même après annonce du gagnant, si les conditions de neige sont défavorables ou pour cause de fermeture totale ou partielle du domaine skiable de l’Alpe d’Huez.

**Règlement du concours :**

1. Le concours est ouvert du 08/03/2024 19h00 au 24/03/2024 19h00.
2. Un gagnant sera sélectionné au hasard parmi toutes les participations admissibles.
3. Le gagnant sera contacté via message direct sur Instagram.
4. Si le gagnant ne répond pas dans les 48 heures suivant la notification, un nouveau gagnant sera sélectionné.
5. Le prix consiste en une journée de ski test personnelle avec forfait et transport offert (si le gagnant respecte la Condition numéro 4.).
6. Le prix est non transférable et ne peut être échangé contre de l'argent.
7. Le transport sera organisé depuis le lieu de rendez-vous fixé entre l’organisateur et le gagnant jusqu'au domaine skiable indiqué.
8. Les participants doivent se conformer aux règles et réglementations du domaine skiable lors de la journée de ski.
9. En participant à ce concours, vous acceptez que votre photo puisse être utilisée à des fins promotionnelles par "@seracs.freeski".

10. En participant à ce concours, vous acceptez d’être filmé ou photographié durant la durée complète de l’événement.

11. Le gagnant devra témoigner d’un niveau minimum requis en ski ; c’est-à-dire être à l’aise lors de descentes sur piste noire, et en hors-piste.

12. En cas de pratique du hors-piste lors de cette journée, l’organisateur ne sera pas tenu responsable d’un quelconque accident.

13. Le gagnant devra accepter et signer le présent contrat, et fournir à l’organisateur une copie de sa pièce d’identité, ainsi qu’une attestation d’assurance couvrant les risques liés à la pratique du ski alpin.

14. Le gagnant devra être muni de chaussures de ski à sa taille et lui convenant le jour de l’évènement, ou en louer au préalable.

15. Le forfait offert sera un forfait journée valable sur l’ensemble du domaine de l’Alpe d’Huez.
